Terms of Service

These Terms of Service (“Terms”) govern your use of Speakpreneur.Ai, including the website at speakpreneur.ai and the web app at speakpreneur.ai/app (the “Service”). The Service is operated by Speakpreneur, LLC (“Speakpreneur.Ai”, “we”, “us”), run by Paul Getter, 15275 Collier Blvd #201-572, Naples, FL 34119. By creating an account or using the Service you agree to these Terms and to our Privacy Policy.
1. Eligibility and accounts
You must be at least 16 years old to use the Service. You must provide a valid email address, confirm it, and keep your password confidential. You are responsible for all activity under your account. One account is for one person; do not share logins.
2. The Service
Speakpreneur.Ai helps you practise public speaking. You record yourself in your browser; the app measures delivery (for example pace, filler words, pauses, volume and pitch variety), produces a Speaker Score, a transcript and AI-generated coaching feedback, and lets you ask follow-up questions (“Ask-the-Coach”). It also includes a teleprompter and progress tracking. Features may change over time.
3. Subscriptions, billing and cancellation
- Access to the app requires a paid monthly subscription. There is no free plan. Current plans: Starter $15/month, Pro $29/month and Elite $79/month (USD, plus any applicable taxes).
- Payments are processed by Stripe. By subscribing you authorise recurring monthly charges to your payment method until you cancel.
- Subscriptions renew automatically each month. You can cancel, change plan or update your payment method at any time from Manage billing in the app’s account menu. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Plan changes are prorated by Stripe. If a payment fails, Stripe may retry it; access ends if the subscription is ultimately unpaid or cancelled.
- Refunds: fees are non-refundable and we do not refund partial months, except where required by law or at our discretion. Contact subscription@speakpreneur.com if you believe you were charged in error.
- We may change prices with advance notice by email; changes apply from your next billing period.
4. Usage limits and fair use
Each plan includes a monthly number of practice sessions, where one session is one full AI coaching review of a recording: Starter 15, Pro 40 and Elite 150 (fair use) per calendar month. Ask-the-Coach follow-up questions do not use session quota but are subject to fair-use limits. Transcription and AI requests are also subject to hourly limits to protect the Service. Unused sessions do not roll over. We may suspend automated, abusive or excessive use.
5. AI feedback is not professional advice
Scores, transcripts and coaching feedback are generated automatically by software and third-party AI models. They may be inaccurate, incomplete or unsuitable for your situation. They are provided for practice and self-improvement only and are not professional, medical, psychological, legal or career advice. Use your own judgement.
6. Your content
You own the speeches, scripts, recordings and transcripts you create (“Your Content”). You give us a limited licence to process Your Content only as needed to run the Service for you, including sending audio and transcripts to our AI providers as described in the Privacy Policy. You are responsible for having the rights to anything you record or upload, including other people’s voices or words.
7. Acceptable use
You agree not to: break the law or infringe others’ rights; record people without their consent; submit unlawful, hateful, harassing or sexually explicit content; attempt to bypass usage limits, the paywall or security; access other users’ data; reverse engineer, scrape or overload the Service; resell or share access; or use the Service to build a competing product or train AI models.
8. Suspension and termination
You may stop using the Service and request deletion of your account at any time (see the Privacy Policy). We may suspend or terminate accounts that violate these Terms or put the Service or others at risk. On termination, your right to use the Service ends.
9. Third-party services
The Service relies on third parties, including Stripe (payments), Supabase (accounts and data), Netlify (hosting), SendGrid (email) and xAI (AI coaching and speech-to-text), and on your browser’s built-in features. Their availability and terms are outside our control.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that it will improve your speaking.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.
12. Indemnity
You agree to indemnify us against claims arising from Your Content or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Collier County, Florida, unless the law of your country of residence requires otherwise.
14. Changes to these Terms
We may update these Terms. We will post the new version here with a new “Last updated” date and, for material changes, notify you by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated Terms.
